By accessing or using GiftIt (“the App”), operated by MyGiftIt LLC (“we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree, do not use the App.

2. Eligibility

You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use the App. By using the App, you represent that you meet this requirement.

3. Account Registration

• You may need to create an account to access certain features.
• You are responsible for maintaining the confidentiality of your login credentials.
• You agree to provide accurate, current, and complete information.
• You are responsible for all activity under your account.

4. Description of Service

The App allows users to:

• Create and share wishlists
• Discover and save gift ideas
• Share links to products from third-party retailers
• Send or receive gifts (where applicable)

We reserve the right to modify or discontinue features at any time.

5. Affiliate Links & Monetization

• The App may include affiliate links to third-party websites and retailers.
• We may earn a commission when users click on or make purchases through these links.
• Affiliate relationships do not influence the inclusion of products unless explicitly stated.
• Prices, availability, and product details are controlled by third-party merchants and may change without notice.
• You acknowledge that purchases made through affiliate links are transactions between you and the third-party retailer, not with us.

6. Third-Party Services

• The App may link to or integrate with third-party services (e.g., retailers, payment processors).
• We do not control and are not responsible for third-party content, policies, or practices.
• Your interactions with third parties are governed by their respective terms and policies.

7. User Content

• You retain ownership of content you upload (e.g., wishlist items, links, images, descriptions).
• By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute it for operating and improving the App.
• You are responsible for ensuring that links you share (including affiliate links, if allowed) comply with applicable laws and do not infringe on third-party rights.

8. Prohibited Conduct

You agree not to:

• Use the App for unlawful purposes
• Mislead users about products, pricing, or affiliate relationships
• Post fraudulent, deceptive, or spammy affiliate links
• Harass, abuse, or harm other users
• Upload malicious code or attempt to disrupt the App

9. Purchases and Payments

• We do not process or fulfill orders made through third-party affiliate links unless explicitly stated.
• All purchases are subject to the third-party retailer’s terms, including refunds, returns, and shipping.
• We are not responsible for disputes arising from purchases made via affiliate links.

10. FTC Disclosure (U.S. Compliance)

• In accordance with Federal Trade Commission guidelines, we disclose that we may receive compensation for purchases made through affiliate links.
• Users who post affiliate links must clearly and conspicuously disclose their affiliate relationships where required by law.

14. Limitation of Liability

15. Indemnification

You agree to indemnify and hold harmless MyGiftIt LLC from any claims, damages, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your misuse of affiliate links or failure to disclose affiliate relationships

16. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes means you accept the updated Terms.

These Terms are governed by the laws of Ohio, USA without regard to conflict of law principles.
